 The Training of New Insurance Law |

New amendment of Insurance Law of People's Republic of China (hereinafter referred to as new Insurance Law) has been adopted on February 28, 2009 at the 7th Session of the Standing Committee of the 11th National People Congress and shall be come into effect on October 1, 2009. The new Insurance Law, compared with the existing Insurance Law, changes about 84 percent in total. As legislators take the protection of insurants as the core idea in this amendment, some changes of the terms shall be completely subversions to present prevailing practices and ideas of the insurance industry, which surely shall cause big impact and influence on insurance industry.
In the purpose to enhance understanding on provisions of new Insurance Law and prepare pro-active measures in advance, China Continent Property & Casualty Insurance Company LTD Shenzhen Branch decided to entrust our law firm to have a comprehensive insurance training for the management and staffs of different departments of the company on the new law.
Our law firm has been commissioned as legal counselor by China Continent Property & Casualty Insurance Company LTD Shenzhen Branch hereinafter (referred to as China Continent)since the beginning of 2005. Through years of considerate and close legal services, we have created values for our clients as well as cultivated an expertise team well commanded with rich practical experience and legal skills in the field of insurance. Upon receipt of the request from China Continent, we prepared a training draft promptly, and then Partner Yang Nie, and Lawyer Jingxiong Zhang addressed lectures respectively on last Friday and Saturday to the management and the whole staffs of the company. In the training, our lawyers combined with practical case, as well as guidance of the highest court and made a detailed analysis and interpretation on the focal issues of the new Insurance Law, such as non-defense rules, abstentions and estoppels, the effectiveness of exemption clauses, timely notification obligations, the duration of insurance companies in claim settlement, the automatically change of the contract parties, the rights of third parties in liability insurance. Besides, they also answered these questions raised by the management and staffs in detail on site.
In order to assist China Continent to improve their existing work flows and enhance their work skills in claim settlement in accordance with new Insurance Law to avoid unnecessary losses caused by its implementation, our lawyers also pointed at some key provisions and put forwards corresponding countermeasures in the training process for the company's reference
